Mediation Process


What is the Mediation Process? Generally speaking:

Step One -    you have an issue with someone, such as your spouse, that you are unable to resolve between yourselves.

Step Two -    you both agree that you would like to try mediation as a way to resolve the conflict.

Step Three -    you both agree on a mediator.

Step Four -    you schedule time with a mediator.

Step Five -    you give the mediator background information on your issues by completing the Intake Questionnaire. The Questionnaire works best if each person completes theirs separately from the other person so as not to taint the answers. If possible, get the Questionnaires to the mediation ahead of time.

Step Six -    you both meet with the mediator at the arranged time and location. Be on time! Remember your signed Rules.

Step Seven -    the mediator provides general information to both of you.

Step Eight -    the mediator meets with each of you (separately, if needed) to understand each person's side of the story and to highlight the common ground.

Step Nine -    the mediator reviews the common ground and presents that as a possible solution to the issue. If the parties agree, you proceed to Step Ten, if not, you go back to Step Eight. If after several attempts to find a common ground it is clear there will be no resolution, you proceed to Step Eleven.

Step Ten -    a resolution is drafted incorporating the agreed resolution of the parties and is signed by all.

Step Eleven -    the mediator is paid for his or her time.
